Terms of Service
Last updated: October 28, 2026
Please read these terms carefully. Section 15 requires most disputes to be resolved by individual arbitration and waives class actions.
1. Acceptance of Terms
By using geraniumstreet.com, requesting a quote, or buying from us, you agree to these terms. If you do not agree, do not use the website or our products.
2. Who We Are
This website is operated by Geranium Street USA, Inc., 426 Venture St, Escondido, CA 92029 (“Geranium Street,” “we,” “us”). We sell artificial living wall, hedge, and foliage products and ship them within the United States. In California, installation is performed by Califauxscapes, our installation division, under CSLB license #955154, under a separate written installation contract. Outside California, we supply products only, for your own installer or contractor.
3. Quote Cart, Quotes & Orders
- This website does not take payment or accept orders. Adding products to the quote cart and sending it, or submitting any form, is a request for a quote. It is not an order and does not obligate either of us.
- Prices on the website are starting prices or per-case prices. They do not include freight, tax, or installation unless stated. Your written quote sets the final price.
- We may correct errors in prices, product details, or availability at any time before you accept a written quote, and we may decline any quote request or order.
- An order exists only when you accept our written quote, or sign a purchase order or contract, and we confirm it. If a written quote or contract conflicts with these terms, the written quote or contract controls for that order.
- Quoted prices are valid for 30 days unless the quote says otherwise.
- Custom orders may require a deposit before production begins.
- We aim to respond to quote requests within 48 hours. This is a goal, not a guarantee.
4. Your Responsibilities
You are responsible for:
- The accuracy of the measurements, quantities, photos, plans, and site information you give us. Quotes and orders are based on what you provide.
- Confirming that our products suit your intended use and location, including wind, sun, and weather exposure.
- Confirming that the wall, fence, frame, or structure that will carry the products is sound and can support them, and securing the products so they cannot fall, blow loose, or tip over.
- Obtaining any permits, landlord, HOA, venue, or other approvals your project needs, and complying with building, fire, pool-barrier, and other codes that apply to your project.
- Installation by your own installer or contractor when we supply products only. We are not responsible for installation work we did not perform.
- Safe use of the products. Our products are decorative. They are not structural, load-bearing, safety, or fall-protection products, and they are not designed to stop a person, animal, or vehicle. When products are used on equestrian jumps, at events, or around animals or people, you are responsible for safe placement and for supervising their use.
5. Shipping, Delivery & Risk of Loss
- Freight cost, delivery method, and delivery timing are set in your quote. Delivery dates are estimates, and we are not liable for carrier delays.
- Unless your quote says otherwise, risk of loss passes to you when the products are delivered to the carrier.
- Inspect your delivery when it arrives. Note any visible damage on the delivery receipt and report damage, shortages, or wrong items to us in writing within 3 business days of delivery. Claims reported later may not be accepted.
6. Cancellations & Returns
- Custom, made-to-order, cut-to-size, and special-order products cannot be cancelled once production or ordering has begun, and cannot be returned.
- Stock products may be returned only with our written approval, in new and unused condition and original packaging, and may be subject to a restocking fee and return freight, as stated in your quote.
- Deposits are applied to your order. Deposits on custom work are non-refundable once production or ordering has begun, except where the law requires otherwise.
7. Product Information & Planning Tools
We try to show product colors, textures, and dimensions accurately, but actual products may vary from photographs, samples, and earlier production runs because of manufacturing, dye lots, lighting, and screen settings. Artificial foliage can change in color and appearance over time, especially outdoors. Product specifications, case contents, and prices may change without notice. Calculators, layout drawings, the Living Wall Designer, sightline illustrations, and other planning tools on the website are estimates only; final quantities and layouts are those in your written quote.
8. Fire Documentation
Where we say NFPA 701 Method 2 documentation is available, it applies to the documented foliage, as tested, in applicable configurations. Fire-retardant materials can still burn. Documentation supports a review; acceptance is decided by the venue, fire marshal, building official, or other authority having jurisdiction. We do not guarantee that any product or installation will be approved, and you are responsible for obtaining that approval.
9. Installation Services
- Installation in California is performed by Califauxscapes under CSLB license #955154 under a separate written contract. That contract’s scope, schedule, price, and terms control the installation.
- Installation timelines are estimates and may change with site conditions, weather, and material availability.
- You must provide safe, clear access to the work area.
- Structural work, and confirming that a wall, fence, or structure can carry the installation, is your responsibility unless it is included in the written installation contract.
10. Warranties
Any warranty for a product or an installation is only the one stated in your written quote or contract. Nothing on this website creates a warranty, and no employee or representative can create one orally.
EXCEPT FOR ANY WARRANTY STATED IN YOUR WRITTEN QUOTE OR CONTRACT, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND OUR PRODUCTS ARE PROVIDED “AS IS,” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow these disclaimers, so they may not fully apply to you. This section does not limit rights you have under law that cannot be waived.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) GERANIUM STREET USA, INC. AND ITS DIVISIONS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR PROPERTY DAMAGE CAUSED BY WIND, WEATHER, OR IMPROPER MOUNTING OR USE, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SPECIFIC PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM, AND FOR ANY CLAIM ARISING ONLY FROM USE OF THIS WEBSITE, TO $100. These limits do not apply to liability that cannot be limited by law, such as for fraud or willful misconduct. Some jurisdictions do not allow these limits, so they may not fully apply to you.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Geranium Street USA, Inc. and its divisions, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: your violation of these terms; inaccurate information you gave us; installation, mounting, or securing of products by you or your contractors; your failure to obtain required permits or approvals; or your use of the products, including on equestrian jumps, at events, or around animals or people.
13. Project Photos & Designs
Drawings, renderings, layouts, and proposals we prepare remain our property and may be used only to evaluate and complete your project with us. We may photograph installations we supply or perform and use the photos in our marketing, without identifying you by name, unless you ask us in writing not to.
14. Intellectual Property & Website Use
All content on this website, including text, graphics, logos, images, videos, and software, belongs to Geranium Street USA, Inc. or its content suppliers and is protected by copyright law. You may not reproduce, distribute, modify, or create derivative works from it without our written permission. When using the website, you agree not to submit false or misleading information, attempt unauthorized access to our systems, use the website for any unlawful purpose, interfere with its operation, or scrape or harvest content by automated means. Links to other websites are provided for convenience; we are not responsible for their content.
15. Disputes & Arbitration
- Talk to us first. Before starting any claim, send us a written description of the dispute and give us 30 days to try to resolve it.
- Arbitration. Any dispute arising from these terms, the website, or our products or services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, in San Diego County, California, or by video conference. Either party may instead bring an individual claim in small claims court if it qualifies.
- No class actions. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY LAW. The arbitrator may award relief only to the individual party bringing the claim.
- Time limit. To the extent permitted by law, any claim must be brought within one year after it arises.
- If this arbitration section is found unenforceable for a claim, that claim will be heard only in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction.
16. Governing Law
These terms are governed by the laws of the State of California and, where applicable, the Federal Arbitration Act, without regard to conflict-of-law rules.
17. Events Beyond Our Control
We are not liable for delays or failures caused by events beyond our reasonable control, including supplier or carrier delays, shortages, weather, natural disasters, labor disputes, or government action.
18. Changes, Severability & Entire Terms
We may update these terms. Changes take effect when posted on this page, and the date at the top shows the latest version; the terms in effect when you accept a written quote apply to that order. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, together with any written quote or contract, are the entire agreement between you and us about their subject.
